Constitution

 

 1.       Name

The name of the group shall be ‘Stamford Hill Neighbourhood Forum (The Forum).

 2.       Purpose

The purpose of the Stamford Hill Neighbourhood Forum is to further the social, economic and environmental wellbeing of those in the Forum Area.

 3.       Area

The Neighbourhood Area covered by the Stamford Hill Neighbourhood Forum are the 4 wards of Cazenove, New River, Lordship and Springfield. [1]

 4.       Operating Principles

The Forum will operate by the following principles and will:

·         Be inclusive and open to all.

·         Be representative of diversity of the area.

·         Support development that is consistent with Hackney’s Local Development Framework.

·         Support development that responds to community needs and promotes sustainable development, while being consistent with good design principles and maintaining the character of the built environment’.

 5.       Objectives

The Forum’s intention is to develop a Neighbourhood Plan that will map the demographic make-up of the area, identify needs and identify sustainable solutions including opportunities for:

·         Development of educational and community infrastructure.

·         Meeting housing needs.

·         Public realm improvements.

·         Economic development.

·         Improving transport infrastructure.

 

 

6.       Membership

There will be two types of membership of the Forum:

·         Individuals.  Any individual living or working in the Area are eligible to register as a Forum member.

·         Organisations.  Any organisation or business based in the Area is eligible to register as a Forum member.

Organisation members will apply under one of the following 7 categories:

-          Community and faith organisations

-          Health organisations

-          Housing and development organisations

-          Education organisations

-          Environmental organisations

-          Tenants and Residents Associations

-          Business sector.

 

No individual or organisation will be able to take up more than one type of membership.  

 

The committee may take steps to investigate eligibility for Forum membership and deny membership if there are proper ground for doing so.

 

7.       The Committee –purpose and composition

The Forum will elect a committee to govern its activities and ensure its purpose is being carried out.  The committee will comprise 21 members and 3 councillors, one councillor from each political party with elected representatives in the Area. The management committee members will be made up of 14 resident/worker representatives and 7 organisation representatives, and 3 councillors.

 

An interim management committee comprising of the 24 names as mentioned in Appendix 1, will be established. This arrangement is based on the same numbers and categories as to be established by the Forum in the forthcoming AGM in April 2013. 

 

This interim process is in order to facilitate the, submission of a formal application, to be officially recognised as the Stamford Hill Neighbourhood Forum and, is only an interim process until the forthcoming AGM in April 2013 where the membership will be reviewed and duly elected.

 

Following recognition the membership of the Committee will be reviewed following a consultation process and engagement by the interim management committee, with the Stamford Hill Community, as a whole, following which a mechanism will be built, in relation to identification of individuals who would represent the various communities and groups that collectively make up the Stamford Hill Neighbourhood.

 

The Neighbourhood planned process will evolve following consultation and engagement as described above.

 

The Management Committee will meet at least 4 times a year.

 

8.       The Committee - method of election

8.1 Resident/Worker Representatives

All resident and worker members of the Forum will vote for 14 resident/worker representatives.

 

8.2 Organisation Representatives

Organisation members will belong to the following groups:

 

-          Community and faith organisations

-          Health organisations

-          Housing and development organisations

-          Education organisations

-          Environmental organisations

-          Tenants and Residents Associations

-          Business sector.

 

Each group will be governed by Terms of Reference, including its composition, to be agreed at the forthcoming AGM, which will give detailed instructions on how the respective representative on the Forum will communicate decisions of the Forum to their respective organisation, evidencing how this was done i.e. through reports. 

 

 Organisation members in each group will elect a representative, who will be required to represent their group’s views on the management committee.  Each group will also elect a deputy representative who will also attend Management Committee meetings in an ex-officio capacity. 

 

8.3 Councillors

Each political party with elected representation in the Neighbourhood Area will elect or appoint a local ward councillor to the management committee.

 

8.4 Professional expertise

A small group of professionals with planning and development expertise will be recruited to provide advice to the Forum, and to participate in meetings in an ex-officio capacity.

 

9.       Executive Committee

9.1 Composition

The Committee shall elect an Executive Committee to carry out its intentions, made up of 6 Officers:

-          Chair

-          Vice Chair

-          Treasurer

-          Secretary

-          Assistant Secretary

-          Officer without Portfolio

-           

The Executive Committee shall meet as often as is necessary to implement the work of the Forum and, may delegate powers on specific matters to such persons as it sees fit.   They will have the power to take decision on urgent matters between meetings of the Management Committee, subject to at least 4 Officers being in agreement.

An interim executive committee comprising of 7 names as mentioned in Appendix 1, will be established.  This arrangement mirrors the same methodology as to be established by the Forum in the forthcoming AGM in April 2013.

9.2   Chair

The Chair of the Management Committee, shall:

                                i.            Call and chair regular meetings of the Committee (for which a quorum will be one half of its members) and have a casting vote on elections and resolutions.

                              ii.            Chair meetings of the Executive Committee.

                            iii.            Act on behalf of the ‘Stamford Hill Neighbourhood Forum’ and represent it externally.

                            iv.            Act as joint signatory on the ‘Stamford Hill Neighbourhood Forum’ bank account.

 

9.3   Vice Chair

The Vice Chair shall act on behalf of the Chair in the event of their absence. 

 

9.4   Treasurer

The Treasure shall:

i.                     Be responsible for maintaining the accounts of the ‘Stamford Hill Neighbourhood Forum’

ii.                  Be responsible for presenting a budget, annually for the following year to a Representatives Group Meeting

iii.                Submit a detailed summary of the accounts at every Management Committee Meeting

iv.                 Act as a joint signatory on the ‘Stamford Hill Neighbourhood Forum’ account

v.                   Present annual accounts to the Management Committee and the Forum meetings.

 

9.5   Secretary

The Secretary Shall:

i.                    Be responsible for organising meetings, and maintaining and circulating the minutes.

ii.                  Be responsible for correspondence.

iii.                Maintain Membership lists.

iv.                 Act as joint signatory on the ‘Stamford Hill Neighbourhood Forum’ account.

 

10.   Stamford Hill Neighbourhood Forum Meetings

The Stamford Hill Neighbourhood Forum will meet at least twice each year. One of these meetings will be the Annual General Meeting at which elections to the Management Committee will be conducted.

 

At least 7 days notification must be given to its members for a Forum Meeting.

 

The Forum Meeting may:

                                i.            Receive and comment on the report from the Management Committee.

                              ii.            Amend the Area.

                            iii.            Approve the annual report and accounts where relevant.

                            iv.            Adopt constitutional amendments.

 

At least 5% of the membership must be present at the start of the Forum Meeting for it to be declared quorate. The Chair of the Management Committee shall chair the proceedings.

All Forum members shall be entitled to attend the Forum Meeting to propose and vote for motions and to stand for election.

 

All voting, other than elections to the management committee, shall be by a show of hands.

11.   Affiliations, Operations and Independence

Stamford Hill Neighbourhood Forum’ shall not be affiliated to any political party or organisation.

All members of the Forum shall act in meetings of the Forum, the Representative Group and the Management Committee in the best interests of the Forum and the residents of the area.

The Forum shall act in accordance with best practice in the preparation of neighbourhood plans and in accordance with Government guidance for such preparation and shall seek to work collaboratively with the Local Planning Authority to achieve this.

12.   Constitutional Amendments

Constitutional amendments shall require a majority of 60% (other than to comply with the law) at a Forum Meeting.

 

The Constitution shall be reviewed once public consultation about designation has been conducted.

 

13.   Distribution of Wind-Up

A majority of the members of the Forum shall decide the distribution of any money in the event of a wind-up. Any assets / money remaining shall go to local community-based organisations.

 



[1] The Forum will consult on an option of including only the eastern part of Lordship Ward, up to Lordship Road, taking into account new proposals for ward boundaries from the Boundary Commission.
